1. Our agreement with you

These Terms govern your access to Arch's dating and social introduction service, including its applications, related websites, account tools, communications, subscriptions, and other features expressly offered under these Terms (collectively, the “Services”). “Arch,” “we,” “us,” and “our” mean the operator identified above. “You” means the person using the Services.

You enter this agreement when you affirmatively accept these Terms through the acceptance process provided by Arch. We will make a version available that you can retain. If you do not agree, do not create an account or use the Services. Merely viewing marketing material does not authorize us to charge you.

Additional terms may apply to a particular purchase, promotion, event, integration, or feature. We will identify those terms and make them available before you commit to that activity, obtaining separate acceptance when required. The purchase confirmation forms part of your agreement for that purchase. An undisclosed internal policy does not impose obligations on you.

If provisions conflict, mandatory law and mandatory local notices control first, followed by expressly applicable local terms, specific purchase or feature terms for their subject matter, and these general Terms. A later general statement does not silently remove a specific paid entitlement. The Privacy Policy describes our handling of personal information; accepting these Terms does not substitute for any separate privacy consent that the law requires.

2. Eligibility and personal use

You must be at least 18 years old and have the legal capacity to enter this agreement in your place of residence. Arch is not intended for children. You must not help anyone under 18 create an account or use your account.

You may use the Services only where we offer them and where doing so is lawful. You must not use the Services in breach of a court order, a legal restriction on contacting another person, or an applicable sanctions or export restriction. You must not evade an Arch suspension or removal by changing accounts, identities, devices, or location information.

Accounts are for individual, personal use. Unless Arch expressly authorizes a different account type, you may maintain one active account, must control it yourself, and must not sell, rent, transfer, or operate it for someone else. A person may return after voluntarily deleting an account if otherwise eligible; deletion does not reverse a moderation restriction.

We may ask for information reasonably necessary to establish eligibility, secure an account, investigate a report, or comply with law. Any verification involving identity documents, biometric information, or a third-party check requires the disclosures and, where applicable, consent described in Schedule A before collection.

3. Registration, sign-in, and account security

Use an authorized sign-in method offered in the app. Sign in with Apple, and any email-code, phone, passkey, or other sign-in method we subsequently offer, remain subject to their disclosed requirements. Access may depend on maintaining access to the relevant Apple account, email address, telephone number, or device. Arch does not need your Apple password; never send it or a one-time verification code to another member or to someone claiming to provide support.

Provide accurate registration information and keep information needed for account notices current. Keep your device and sign-in credentials reasonably secure, and tell us promptly if you suspect unauthorized access. You are responsible for activity you authorize and for your own misuse; these Terms do not make you automatically liable for activity caused by our security failures or contrary to applicable law.

Device integrity and anti-abuse checks may identify previously used or restricted devices. Such checks can be imperfect, including when a device changes owners. Contact us if you believe a restriction has been applied to you incorrectly. A successful sign-in or device check establishes neither a member's real-world identity nor their trustworthiness.

4. Profiles, photographs, and information you provide

Your profile may include your name, age derived from your birth date, gender, optional pronouns, selected location, height, work, photographs, written answers, and interests. Give an honest representation of yourself. A chosen name or pronouns are welcome; impersonation, deceptive age information, and profiles operated for another person are not.

The app identifies required fields, completion requirements, and upload limits. The present profile design uses four to six photographs, three written prompt answers, and three interests. Limits may differ for a clearly described feature or plan. Some information may be fixed after entry to prevent abuse; contact support to correct an error that the app does not let you correct directly.

Your principal profile photograph must clearly depict you as you currently appear, on your own, with your face visible. Other photographs may show your activities, surroundings, or other people where you have the necessary rights and permissions. Do not use misleading synthetic portraits, someone else's likeness, explicit images, images containing private contact information, or images that fail the published quality requirements. Do not upload intimate images of another person or any sexualized depiction of a minor. Avoid uploading identifiable children; any permitted incidental family photograph must be lawful, nonsexual, and supported by appropriate permission.

You must own or have permission to upload everything you submit, including photographs taken by someone else and material depicting other people. Public availability on another website does not establish permission. Do not include another person's confidential information, identity documents, financial details, or contact details without a lawful basis.

Uploads may be cropped, compressed, resized, reordered at your direction, or rejected. Upload completion or a visible photograph does not mean Arch has verified the image or the person it depicts. Removing content may affect whether your profile satisfies discovery requirements.

5. Questionnaire and compatibility

Arch uses your discovery preferences and compatibility questionnaire to help select introductions. The current questionnaire contains sixteen questions concerning everyday preferences, communication, lifestyle, and relationship expectations. Answer honestly rather than attempting to manipulate selection.

Your private questionnaire responses and discovery preferences are not intended to be displayed to other members as profile fields. Arch and its service providers process them to operate matching and for other purposes specifically explained in the Privacy Policy. Private means restricted from ordinary member access; it does not mean that information is never processed by our systems, authorized personnel, or providers, or cannot be disclosed when law requires it.

Matching uses computational comparisons, including internal compatibility values and eligibility rules. An introduction is a recommendation, not a psychological assessment or a scientific finding that two people are compatible. Arch does not promise a particular relationship outcome or a validated measure of personality, attractiveness, character, or safety.

The app may limit how frequently you replace questionnaire answers. The current free-service design generally allows replacement after thirty days, with more frequent replacement offered as a Premium benefit where available. Changes normally affect future selection rather than undoing messages or introductions already made. These ordinary product limits do not restrict a statutory right to correct inaccurate personal information; contact the privacy contact for such requests.

6. Location and discovery preferences

Where offered, you may select a supported place or choose to obtain a location from your device. Device access requires the relevant operating-system permission. The current app is designed to obtain a location on request and round the location used by Arch to a coarse geographic area, rather than continuously track your movement. The Privacy Policy explains the actual collection, storage, and provider processing involved.

Approximate distance and place information can be inaccurate, outdated, or user-selected. A displayed town or neighbourhood is not proof of where someone currently is, lives, or intends to meet. Travel or location-selection features may allow a member to choose a place before arriving there.

Age, gender-selection, distance, and other stated eligibility filters operate on available information and the settings saved for the relevant selection cycle. Distance is an approximation rather than travel time or a route measurement. Selecting “Anywhere” removes the corresponding distance ceiling; it does not restrict discovery to the numerical value at the end of a slider. Any future additional filters will be described when offered.

We do not guarantee that suitable members exist within your preferences. Narrow preferences, an incomplete profile, limited local participation, pauses, restrictions, or conversation limits can reduce or prevent introductions. We will not represent a required filter as optional merely to fill a roster.

7. Rosters, introductions, dismissal, and availability

Arch provides a limited roster of people to consider. The standard design offers capacity for up to five people; an eligible Premium plan may offer up to eight. These are capacity limits, not a promise that every slot will always be filled or that a new person will arrive in every slot every day.

New pairings are designed to be mutual when created: each person is selected for the other. That does not mean either person has liked the other, reviewed their profile, agreed to a date, or consented to any interaction outside the Services. Availability can change afterward.

A person may remain in your roster across selection cycles while still eligible. Dismissing a person takes effect at the next scheduled refill, and until then you can reverse it; once it takes effect it is ordinarily irreversible, and the slot stays open until a later refill. Starting a conversation can remove the person from the roster and open capacity on both sides. Blocking, account changes, updated eligibility, or moderation may also affect availability. A previously shown person may reappear where the applicable rules permit; dismissal is not a permanent block.

Refills ordinarily follow a shared morning schedule based on New York time, with the anticipated time shown in the app. Schedules can be delayed by processing, outages, or a lack of eligible people. An indicated refill time is an estimate, not a guaranteed appointment.

Arch generally does not tell a member who dismissed them or why a slot became available. We may provide information where required by law or reasonably necessary for safety, including fraud warnings. We cannot guarantee that another person will not draw their own conclusions from changes they observe.

Membership does not guarantee introductions, replies, dates, exclusivity, a minimum audience, or a relationship, except for any specific enforceable commitment expressly included in your purchase. This paragraph does not remove a statutory cancellation or refund right arising from a failure to provide referrals or perform the service.

8. Requests and conversations

Where messaging is available, you may write to an eligible person presented through Arch without a separate mutual-like step. The initial message may be treated as a request until the recipient accepts or replies. A recipient is free to decline, ignore, leave, report, or block an interaction. You are never entitled to a reply.

The app may limit message length, attachments, requests, or open conversations. The current design holds further roster access at ten open conversations for the free service and fifteen for eligible Premium accounts. Incoming unanswered requests are treated separately. Applicable limits and what happens when they are reached will be described in the app.

A message may quote a photograph or written answer where that function is supported. Send only content you have the right to send. A sender-side status such as “sent” does not establish that the recipient received, read, understood, or accepted the message. Do not use Arch for urgent or emergency communications.

Leaving a conversation, blocking someone, or deleting an account can stop further replies. Messages already exchanged may remain available to the other participant or may be retained where the Privacy Policy and law permit. Arch is not an archival or backup service, and we do not guarantee indefinite access to a conversation.

The current service does not offer member-facing read receipts, last-online status, profile-view tracking, or compatibility percentages. If we introduce a feature that changes those privacy expectations, we will disclose the change and provide the controls or consent required before activating it.

9. Conduct and community rules

Treat other people with respect and respect their boundaries. The following are prohibited in the Services and in conduct connected with an Arch interaction:

A good-faith report is not a violation merely because we cannot verify it. These rules do not prevent lawful reporting to authorities, obtaining professional advice, preserving evidence, exercising legal rights, or publishing an honest review of Arch.

10. Technical misuse

Do not scrape or harvest profiles, messages, photographs, or personal information; build member databases; perform facial identification on members' photographs; or use member content to train models without the relevant lawful permissions.

Do not use bots, unauthorized agents, emulators, automated messaging, or unofficial clients to evade limits, impersonate personal interactions, manipulate recommendations, or collect data. Do not access another account, probe nonpublic systems without authorization, distribute malware, interfere with availability, or bypass payment, access, moderation, or security controls.

Do not reverse engineer, decompile, or circumvent technical protections except to the extent applicable law expressly permits those activities. Nothing here restricts an applicable open-source licence or lawful security research that cannot be restricted by contract. Report a suspected vulnerability privately to support@archdating.com and avoid accessing or retaining other users' information.

11. Meeting people and safety

You decide whether to communicate, exchange contact information, meet, travel, or enter a relationship with another person. Consent to one interaction is not consent to another. Respect a refusal immediately.

Arch does not conduct criminal-record or sex-offender checks as a standard feature of the service described in this draft. Registration, device checks, photo availability, paid membership, a recommendation, or any future verification badge does not establish that a person is safe, honest, single, or suitable. If a specific verification service is introduced, we will describe what it checks and its limitations.

Use judgment when meeting someone: choose a public place, tell someone you trust your plans, arrange your own transport, and protect sensitive financial and identity information. Do not send money or make investments because someone you met through Arch asks you to do so.

Arch does not supervise private meetings or act as a member's agent. We can consider relevant off-platform conduct in safety decisions, but cannot monitor every interaction. Contact local emergency services if someone faces immediate danger. Reporting through Arch is not an emergency response channel. Your responsibility to make personal decisions does not waive any duty or liability that the law places on Arch.

12. Reporting, moderation, restrictions, and appeals

Use the reporting tools where available or contact support@archdating.com to report abuse, suspected underage use, deceptive profiles, unsafe conduct, or prohibited content. Provide enough information to identify the account or material and explain the concern. Do not obtain evidence unlawfully or unnecessarily forward sensitive or illegal material.

We may review relevant profiles, submitted material, messages, account activity, and report context as described in the Privacy Policy and permitted by law. Authorized personnel and appropriately disclosed automated tools may assist. We do not promise to inspect every item before publication or to detect every violation. Content remaining visible is not an endorsement.

Depending on the circumstances, we may reject an upload, ask for a correction, limit a feature, remove content, pause discovery, suspend or terminate an account, restrict a device, or take other proportionate steps. Relevant grounds include a material breach, a credible safety concern, fraud, an eligibility failure, a legal requirement, or misuse that threatens the service. We may act without advance notice where notice would increase risk, undermine an investigation, or conflict with law.

Where appropriate and lawful, we will explain the general reason and provide a way to contest a decision. Contact us or use the appeal mechanism presented in the app. We may limit duplicate appeals about the same decision while allowing information or rights that the law requires us to consider. We will not promise a specific response time unless we expressly commit to one or law requires it.

We generally limit disclosure of reporters' identities, evidence, and internal security methods. Confidentiality is subject to legal obligations and lawful disclosure, including required notices to people exposed to suspected fraud. The usual practice of presenting an ended conversation without a reason does not override those duties.

A block is intended to prevent future interaction through the blocked account. It cannot retrieve screenshots, messages already received, exported information, or images already downloaded or temporarily cached, and cannot control conduct outside Arch. Unblocking, where supported, does not necessarily restore a conversation or introduction.

An appeal does not automatically restore access. A restriction does not automatically forfeit every prepaid amount or justify continued future billing; purchase remedies are addressed below and remain subject to law.

13. Your content and the permission Arch needs

“Your Content” means material you submit, upload, or send, including profile information, photographs, written answers, interests, messages, reports, and feedback. You retain the ownership and other rights you have in Your Content.

You grant Arch a nonexclusive, worldwide, royalty-free licence to host, store, reproduce, transmit, display, and technically adapt Your Content only as reasonably necessary to provide the Services you request, deliver it to the intended audience, operate authorized features, maintain security, handle reports, and meet legal obligations. Technical adaptations include formatting, resizing, compression, and accessibility functions. Any use for a separately offered translation or AI feature is subject to its disclosures and applicable consent.

We may allow service providers to exercise these permissions on our behalf for those purposes, subject to appropriate restrictions. Other members receive only the access needed to use the Services as intended; this licence does not give them an unrestricted right to republish or commercially exploit your material.

These Terms do not grant a general right to sell your private messages, place your photograph in advertising, use your identity as an endorsement, or train a general-purpose AI model on your private content. A use requiring separate permission must be separately explained and authorized as applicable. Personal-information processing is additionally governed by the Privacy Policy and law.

The licence ends when the relevant material is deleted from the Services, except to the limited extent needed for lawful retention, backup removal cycles, messages already delivered, dispute handling, or records that the law permits or requires us to keep. Retained material remains subject to the purpose and privacy limits above. This paragraph does not authorize indefinite retention merely because retention is technically possible.

14. Other people's content and intellectual property

You may view and interact with member content only through the access the Services provide and for lawful personal use. Do not redistribute a person's profile or messages, create searchable copies, or use them for advertising, harassment, identification, or training datasets without the necessary permissions. Lawful evidence preservation and reporting remain permitted.

Arch and its licensors retain rights in the app, service software, design, branding, and other material they provide. Subject to these Terms and applicable platform rules, you receive a limited, personal, nonexclusive right to access and use the Services while authorized. This gives you no ownership of the Services or right to use Arch's name or branding as an endorsement.

Third-party and open-source components retain their respective licences. Those licences control where they grant rights these Terms cannot remove.

15. Intellectual-property complaints

Send an infringement complaint to support@archdating.com. Identify the protected work or right, the specific allegedly infringing material and where it appears, your contact details, your authority to act, and why you believe the use is unauthorized. Include any statements or signature required by the applicable legal notice process.

We may remove or restrict disputed material, seek clarification, notify the affected member where lawful, and apply measures to repeated infringement. We will provide any counter-notice or restoration procedure required by law. Knowingly false notices may have legal consequences.

If Arch adopts a United States DMCA designated-agent process, the registered agent's current details and the statutory notice and counter-notice procedure will be published on archdating.com. A contact address in these Terms alone does not represent that such registration has been completed.

16. Privacy, sensitive information, and member visibility

Please read the Privacy Policy before submitting personal information. Dating profiles and preferences can reveal sensitive matters, including relationship preferences, sexual orientation, beliefs, lifestyle, and approximate location, directly or by inference. Share information thoughtfully and use the available controls.

Profile content is intended for the members to whom the Services make it available, not for an unrestricted public directory. Nevertheless, recipients can retain information, take screenshots, or share material contrary to these Terms. No online audience restriction can guarantee that information will never leave its intended audience.

The Privacy Policy must explain the categories of information processed, purposes, providers, international transfers where relevant, retention, safeguards, and applicable rights and choices. A feature that requires additional consent will request it before the relevant processing. An optional feature's additional processing is not automatically authorized by your original acceptance of these Terms.

You may exercise applicable access, correction, deletion, portability, objection, consent-withdrawal, or complaint rights through support@archdating.com and any tools we provide. We may reasonably verify a requester's identity. We will assess exemptions and competing rights under applicable law, rather than treating a product rule as an exemption from a legal right.

17. AI profile feedback and profile insights

Where offered, Arch may provide automated feedback on your own photographs and writing. The feature is intended to suggest improvements to presentation and clarity. It is not a human review unless expressly identified as one, professional counselling, an attractiveness rating, identity verification, or a prediction of relationship success.

The feature may send the profile fields and images identified in its disclosure to an external AI provider. The Privacy Policy and the feature disclosure will identify the actual provider arrangements, purposes, and applicable choices before use. Do not submit material you have no right to have processed, and do not submit someone else's profile for analysis through a feature intended for your own profile.

AI output may be inaccurate, incomplete, inconsistent, biased, or unsuitable, and similar output may be supplied to different users. Review suggestions yourself before relying on them or publishing them. You remain responsible for the material you choose to adopt. We do not promise exclusive intellectual-property rights in generated material or that every output is copyrightable.

Reviews may be cached and associated with the content reviewed. A repeat request may return existing feedback. Fresh reviews may have a disclosed daily or rolling limit, and availability may depend on a plan, system capacity, or the AI provider. A paid offer must state material usage limits before purchase.

Where offered, profile insights may summarize which photographs or answers prompted messages. These observations are based on the available interactions and are not a measure of personal worth, popularity, or guaranteed future performance. They do not imply undisclosed tracking of profile views or read receipts.

You may report problematic feedback to support. We may restrict harmful uses of AI features and change models or technical methods, subject to our obligations concerning paid features, privacy, and material changes.

18. Free services and paid offers

Some Services may be free and others may require payment. A displayed Premium offer describes the actual benefits included, supported platforms, material limits, total price, currency, taxes, billing period, renewal terms, and cancellation route. A monthly-equivalent price does not mean a longer subscription is billed monthly; the total amount and payment timing shown at checkout control.

Possible Premium benefits include a larger roster, a higher conversation limit, profile feedback or insights, a chosen discovery location, and more frequent questionnaire updates. Only benefits expressly included in your accepted offer are purchased. A mockup, development preview, roadmap, or unavailable button does not create a charge or a promise to release a feature.

Premium does not purchase another person's attention or consent, guarantee greater visibility or a better match, or grant immunity from moderation. Unless a separate, clearly disclosed feature says otherwise, it changes the stated access or capacity limits rather than purchasing preferential ranking.

Before charging you, we will obtain the purchase authorization required by the relevant payment platform and law. You must use a payment method you are entitled to use. Payment processing may be provided by an app store or another identified provider. Applicable third-party payment terms supplement your purchase but do not remove duties Arch owes you.

19. Subscriptions and automatic renewal

If you purchase a subscription expressly described as automatically renewing, it renews for the disclosed period at the disclosed renewal price unless you cancel or renewal is otherwise stopped. You authorize recurring charges only on the terms presented and accepted at purchase. We will provide confirmations and renewal or reminder notices when required.

Cancel future renewal through the billing provider used for the purchase. For an Apple-billed subscription, use your Apple account's subscription controls. For a direct-billed subscription, use the cancellation control supplied with that subscription or contact support@archdating.com. We will make the applicable process clear and provide legally required accessible cancellation options. Keep the confirmation of cancellation.

Cancel by the deadline clearly disclosed by the billing provider to avoid the next charge. Unless the accepted offer or law provides otherwise, cancellation of future renewal leaves access available until the end of the period already paid for. A legal right to end immediately or obtain a refund is separate from turning off renewal.

Uninstalling the app, signing out, stopping use, or pausing discovery does not by itself notify an external billing provider to cancel. Account deletion also does not reliably cancel an app-store subscription. We will identify the necessary cancellation action in the deletion flow. This does not permit charges after a cancellation that is effective under law.

If we offer a trial or introductory price, the offer will state its length, eligibility conditions, the later price, whether it converts automatically, and how and when to cancel. We will obtain required consent and provide required reminders. There is no trial or automatic conversion unless your offer says so.

Price increases apply only prospectively, with the notice and consent required by law and the billing provider. We will not change the price already paid for a completed billing period. If required consent is not given, the affected renewal will not proceed at the increased price.

20. Billing issues, restoration, and plan changes

Contact the billing provider or Arch about a disputed, duplicate, or unauthorized charge. These Terms do not restrict a good-faith chargeback or other statutory payment remedy. We may investigate suspected payment fraud, but a good-faith payment dispute is not by itself proof of abuse.

Where purchase restoration is supported, it depends on a valid entitlement and the account or store identity to which it belongs. Restoration does not revive an expired or refunded entitlement, transfer a personal subscription to another member, or reverse a safety restriction. Contact support when a valid entitlement is missing.

Upgrades, downgrades, prorations, credits, and changes between billing providers follow the terms displayed when you make the change and applicable law. When a paid entitlement expires, the free-service limits can apply again. Additional roster slots or other premium-only access may cease, and you may need to reduce activity before starting new interactions. Existing messages are handled under the ordinary retention rules rather than promised as a permanent premium archive.

We may suspend a paid feature after a payment fails, expires, or is reversed, subject to any required notice, grace period, and legal rights. We will not charge for a replacement or additional plan without authorization.

21. Refunds and statutory cancellation rights

Your mandatory consumer rights take priority over every purchase term. Depending on applicable law, you may have rights relating to a cooling-off period, dating-service cancellation, a failure to provide introductions, death or disability, relocation, an undisclosed renewal, defective performance, or failure to supply required contract information. Any required local notice or form accompanies the relevant offer.

Outside those rights, the refund policy disclosed before purchase applies. Ordinary dissatisfaction with a date, a lack of replies, or nonuse does not by itself establish a refund entitlement under these Terms. Conversely, describing fees as nonrefundable cannot eliminate a right the law gives you.

For Apple-billed transactions, Apple's refund process may be the available processing route. We will explain that route and cooperate where needed; we do not disclaim obligations that remain Arch's under law. For direct purchases, request help at support@archdating.com. A legally effective notice may be sent by any method the law permits, even if our preferred process differs.

If Arch permanently discontinues a paid service before the end of your paid period, or removes a material purchased benefit without providing a reasonably equivalent benefit you accept where required, we will provide an appropriate remedy, including a proportionate refund for the unused affected service where applicable. We will not retain payment for service we are legally required to refund.

If you permanently relocate outside our supported service area and cannot reasonably use your paid service, contact us to stop renewal and request a proportionate refund of the unused period, subject to any more favourable legal entitlement. We may request reasonable evidence of relocation without requiring excessive personal information.

Termination for a breach does not automatically extinguish a statutory refund right. Any deduction or retention of a prepaid amount must be lawful, proportionate, and consistent with the purchase terms and actual circumstances.

22. Notices, email, push notifications, and permissions

We may provide service, security, transaction, and legal notices through the app or the contact method associated with your account. Keep that method usable, including any Apple relay address you choose. We will use any delivery method or format that law requires for a particular notice.

Push notifications depend on operating-system permission and your settings. A notification may display a sender's name and message text on a lock screen or connected device; adjust preview settings if others can see your device. Notification delivery can be delayed or fail.

The current product design uses push notifications for incoming messages rather than routine roster reminders. New notification types will be explained and subject to appropriate controls. These Terms do not constitute blanket consent to promotional email, SMS, tracking, or advertising. Marketing permissions and unsubscribe rights are handled separately where required.

If a future telephone or SMS feature is offered, its disclosure will identify the purpose, expected message frequency where relevant, carrier charges, and opt-out method. Withdrawing marketing permission does not necessarily stop essential account or legally required safety notices.

23. Pausing, signing out, and deleting an account

Pausing discovery is intended to stop new discovery activity while preserving your account and existing conversations. It is distinct from a statutory membership hold, a billing pause, signing out, and deleting your account. Available controls will explain their effects. Where a paid membership hold is legally required, we will provide that right separately from an ordinary visibility toggle.

Signing out ends local access without deleting the account. Uninstalling the app alone does not remove the profile, withdraw every consent, erase retained records, or cancel a subscription.

You may request account deletion through the account controls or support@archdating.com. Deletion is intended to remove the active profile and end further interaction. Once processed, it may be irreversible. We will provide the confirmation and information about processing that law requires. If a request fails or no confirmation appears, contact us.

Deletion does not necessarily erase every record immediately. Subject to the Privacy Policy and applicable law, limited account identifiers, security and moderation records, records of consent or transactions, messages received by another participant, and information required for legal claims or compliance may remain for an appropriate period. Backups, cached copies, and provider-held copies require the applicable deletion process. Any local rule requiring earlier deletion, return, or certification takes priority.

We cannot delete copies another person has lawfully retained outside our systems. We may nevertheless act on unlawful disclosures or abuse. Retention for anti-abuse purposes must be limited to a legitimate, lawful purpose and period; these Terms are not consent to retain all account data indefinitely.

24. Data exports

Where an export tool is available, it supplies the data and formats described in that tool. It may require a connection and identity verification. It is not a guarantee that a download contains every internal record or every item covered by a legal access request.

We may need to redact information to protect another person's rights, confidential security information, or a legally recognized exemption. We will assess an actual rights request under applicable law and explain any required grounds for withholding information. An internal policy against showing compatibility scores or reports does not itself establish a legal exemption.

You control where you save or send a downloaded copy. An export may contain sensitive profile information and conversation history; protect it appropriately and respect other participants' rights. Our responsibilities for preparing and delivering the export remain unaffected.

25. Technical requirements, third parties, and availability

Using the Services requires compatible hardware, software, and an internet connection. You are responsible for your ordinary device and carrier charges. We may require updates for security, compatibility, or continued support, with appropriate notice where a change materially affects access you purchased.

Arch relies on third-party services such as Apple sign-in, maps and geocoding, app distribution, push delivery, hosting, storage, and, where enabled, AI or payment providers. Separate terms may apply to your direct relationship with those providers. A third-party interruption may affect Arch, but does not eliminate our own obligations for the service we sell.

We aim to provide the Services with reasonable care and skill. Maintenance, network faults, provider outages, or other events may interrupt availability. We cannot promise uninterrupted or error-free operation, exact message-delivery times, or continuous access to a particular member. We will provide any remedy required for failure to meet a contractual or legal obligation.

External links and independent offers are not endorsements. Before using an external service or sharing information with it, review its terms and privacy information. Arch will identify when it is acting as the supplier of a separately offered service.

26. Experiments, previews, and future functionality

We may offer beta features or conduct reasonable product tests. A beta label will be disclosed before use and will not remove mandatory rights. Features may vary by account, region, operating system, eligibility, or plan. We will not knowingly misrepresent simulated activity as real member interest or promise a feature that is not included in the offer you accept.

Schedule A describes how these Terms apply if particular additional features are introduced. It is not a roadmap, a commitment to build them, or advance consent to all potential data uses. New charges, materially different privacy practices, and materially different contractual obligations require the appropriate advance disclosures and acceptance.

A future feature outside the scope reasonably explained by these Terms will require new or supplemental terms before use where appropriate. Merely adding “including future features” does not make every future transaction or processing purpose part of the original agreement.

27. Service changes and termination by Arch

We may improve, change, or withdraw free features for reasonable operational, safety, legal, or product reasons. For paid services, we will respect the accepted purchase terms and provide the notice, choices, and remedies required for material changes. We will not use a general change clause to remove the substance of a prepaid service without an appropriate remedy.

We may end or restrict your access for the grounds described in these Terms or if continued provision becomes unlawful or impracticable. Where reasonable, we will give notice and a way to address a remediable breach. Serious safety or security issues may require immediate action.

On termination, your right to use the affected Services ends, future renewal will be addressed through the relevant billing channel, and content is handled according to the Privacy Policy and law. You may still contact us about an appeal, payment issue, or privacy right. We will not require access to a closed account as the sole way to exercise those rights.

If we discontinue the Services generally, we will give reasonable notice where practicable and provide the paid-service remedies described above. Provisions that need to continue to address past use, outstanding lawful payments, retained content, intellectual property, disputes, and nonwaivable rights survive only to the extent relevant.

28. Changes to these Terms

We may revise these Terms to reflect actual service changes, legal requirements, security needs, or business arrangements. We will publish the updated version and effective date. For a material change that adversely affects an existing user, we will normally provide at least thirty days' advance notice, unless law requires a different period or an urgent legal or security reason reasonably requires earlier action.

We will obtain affirmative acceptance where the nature of a change or applicable law requires it. Continued use alone is not treated as consent to a new charge, a new sensitive-data purpose, or a waiver that requires express agreement. Changes do not retroactively remove accrued rights or alter a dispute already arisen unless the parties lawfully agree.

If you decline a material change, you may stop using the affected service and cancel future renewal. Your rights concerning an existing paid period, refunds, access to retained information, and disputes remain subject to the accepted terms and law. We will provide any cancellation remedy required for a unilateral change.

29. Warranties and service limitations

Nothing in these Terms excludes a warranty, condition, guarantee, or duty that cannot legally be excluded, including applicable obligations of reasonable care, conformity with description, and consumer protection.

Subject to those rights and our express commitments, the Services are provided as available. We do not warrant that every member statement is accurate, that every interaction is safe, that AI feedback is correct, that recommendations will result in a relationship, or that the Services will meet every personal expectation. We cannot guarantee that other users will comply with these Terms.

We remain responsible to the extent the law makes us responsible for our own acts, omissions, representations, and contractual performance. Neither an availability limitation nor a safety statement is a release of all claims against Arch.

30. Liability

This clause applies only to the extent permitted by the law governing your claim. It does not exclude or limit liability that cannot lawfully be limited, including applicable liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or nonwaivable consumer and privacy rights. It does not cap a refund, payment reversal, or other remedy the law requires us to provide.

Subject to those exceptions, Arch is not liable for losses that were not reasonably foreseeable when the agreement was made, losses not caused by our breach or legal responsibility, or business losses arising from use of a service supplied for personal purposes. We do not impose an exclusion merely by describing a legally recoverable loss as “indirect.”

For claims that may lawfully be capped, Arch's aggregate liability arising from the same event or related series of events is limited to the greater of the amounts you paid Arch for the affected Services during the twelve months before that event and CAD $100. This limit does not expand an exclusion prohibited by your local law or replace a more favourable mandatory remedy.

31. Responsibility for third-party claims

To the extent lawful and proportionate, you are responsible for third-party claims and reasonable, actually incurred costs directly caused by your intentional unlawful use of the Services, your knowing infringement of someone else's rights through Your Content, or your fraudulent misrepresentation to Arch.

This obligation does not cover Arch's own breach, negligence, misconduct, or a claim merely because you exercised a consumer right, reported wrongdoing, or used the Services as intended. We must notify you reasonably promptly, take reasonable steps to limit loss, allow you a fair opportunity to participate, and obtain your consent before a settlement imposes an admission or nonmonetary obligation on you. We cannot recover the same loss twice. This clause does not apply where consumer law prohibits such an obligation.

32. Disputes, governing law, and courts

Contact support@archdating.com if you wish to try to resolve a dispute informally. Describe the problem and the remedy requested. Informal contact is optional unless a lawful, separately applicable procedure says otherwise; it does not prevent urgent relief, a regulator complaint, or timely proceedings.

Subject to mandatory consumer protections, this agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. The courts of Ottawa, Ontario have nonexclusive jurisdiction. A consumer retains any right to rely on mandatory local law or bring proceedings in a court available under that law. This provision does not force a consumer to litigate abroad where prohibited.

These Terms do not impose mandatory arbitration, waive a jury trial, waive participation in a class or representative action, shorten statutory limitation periods, or release unknown claims. Any future proposal to change dispute resolution must be separately assessed and lawfully accepted; it will not be introduced retroactively through a general update.

33. General provisions and contact

These Terms and the applicable accepted purchase and feature terms form the agreement for their subject matter. They do not exclude reliance on representations or statutory rights that the law protects. Failure to enforce a provision once does not waive it for every future situation.

If a provision is invalid, it will be limited or disregarded only to the extent lawful, leaving the remainder effective if it can fairly operate. This does not authorize rewriting an unfair consumer term to avoid a remedy the law requires.

You may not transfer a personal account or contractual rights without permission except where law permits. Arch may transfer this agreement as part of a lawful reorganization or transfer of the Services if the successor assumes its obligations and your rights are not materially reduced without required notice and remedies. Transfer of an agreement is not unrestricted permission to sell or transfer sensitive personal information; privacy law and any required separate consent still apply.

Events beyond a party's reasonable control may excuse delayed performance only to the extent the law permits and while reasonable mitigation is undertaken. They do not automatically excuse keeping payment for an undelivered service or prevent statutory cancellation.

You and Arch are independent parties. These Terms do not create an employment, agency, partnership, or joint venture relationship. Apart from rights expressly provided by an applicable app-store licence or law, they do not create enforcement rights for unrelated third parties.

Where multiple language versions are provided, we will identify their status consistently with applicable law. No general English-language priority clause overrides a mandatory language requirement or a consumer's right to rely on a legally protected version.

Contact Arch at the addresses listed at the beginning of these Terms. A notice will be handled according to applicable delivery rules; these Terms do not treat every unopened push notification as legally conclusive notice.

Schedule A — Additional features, only if introduced

A1. Additional platforms, authentication, and integrations. The same conduct and account rules apply to an authorized web, Android, desktop, or other version. Platform-specific functionality and billing may differ and will be disclosed. Linking an external account or importing data authorizes only the connection and data access described in that process. You must have authority to connect it. You may disconnect through the controls provided, subject to lawful retention and obligations already incurred.

A2. Phone verification, identity checks, and verification badges. Before a check, Arch will explain the information required, purpose, relevant provider, retention, and consequences of refusing or failing the check. A badge means only that the stated check was completed at the stated time; it is not a guarantee of safety, legal status, or future conduct. Biometric processing, background checks, and identity-document retention require their own appropriate notices and lawful basis. These Terms alone do not authorize them.

A3. Voice, video, calls, livestreams, and media messages. Conduct rules apply equally to audio, video, images, and live interactions. Obtain any consent legally required before recording or sharing an interaction. Arch will disclose whether it records, transcribes, translates, or moderates a session and obtain required permission before doing so. An operating-system microphone or camera permission does not by itself constitute agreement to every possible use. Live features are not emergency services, and Arch cannot guarantee that another participant will obey recording restrictions.

A4. Groups, communities, comments, reactions, and expanded discovery. Visibility and membership rules will be displayed before you post or join. A group administrator may administer a space within its disclosed rules, but cannot override these Terms or the law. Likes, reactions, saves, follows, expanded rosters, additional prompts, or new filters do not signify consent to contact outside the feature's rules. We will explain any change from Arch's ordinary mutual-roster model before use.

A5. Travel and location modes. A selected destination may be used for discovery without establishing physical presence there. The feature will disclose how it is presented to others and what happens when the entitlement expires. Do not use location tools to stalk someone or evade lawful geographic restrictions. Live location sharing, route tracking, or background tracking would require specific disclosures and permissions beyond the current location feature.

A6. Additional AI tools. Profile drafting, translation, conversation suggestions, recommendations, summaries, image tools, or coaching require disclosure of the data used and whether a third-party model processes it. Review results before use. Do not use them to impersonate another person, fabricate a real-world identity, generate nonconsensual intimate material, manipulate someone deceptively, or automate unwanted contact. AI coaching is not a substitute for professional health or relationship care. Arch will identify an Arch-operated conversational bot as automated rather than pass it off as a genuine dating prospect.

A7. Refills, boosts, priority placement, or other one-time features. A purchase must identify the exact benefit, its duration or use, availability conditions, and any effect on recommendations or visibility. A boost purchases only the clearly stated distribution benefit, not attention or a response. A refill can be fulfilled only according to the disclosed availability rules. Arch must provide an appropriate remedy if it cannot deliver a purchased benefit. Introducing paid ranking or immediate refills would require clear notice because those features differ from the present product design.

A8. Credits, virtual items, and gifts. If offered, checkout will identify the price, permitted uses, redemption conditions, transferability, and any lawful expiry rule. They have no cash or investment value unless expressly stated or required by law. Do not resell, gamble with, or use them to move money unlawfully. Mandatory gift-card, stored-value, refund, unclaimed-property, and consumer rules take priority. These Terms do not themselves establish an expiry date or authorize confiscation of an unused balance.

A9. Promotions, referral programs, and competitions. Each program must provide its eligibility, dates, reward, material limits, and rules before participation. Do not spam, create sham accounts, self-refer deceptively, or misrepresent an incentive. Disclose incentivized endorsements where required. A prize competition or sweepstakes requires separate official rules; this clause does not launch one or authorize a lottery.

A10. Events, introductions by staff, and third-party bookings. Before payment or commitment, the offer must identify the organizer or supplier, what is included, venue or access requirements, cancellation and refund rules, and any separate event terms. Attendees must respect others' consent and conduct rules. Arch is responsible for the obligations it actually undertakes and may not disclaim an organizer role it in fact performs. Medical, travel, transport, alcohol, accessibility, and event-specific risks must be addressed in the relevant offering where applicable. There is no blanket waiver of injury claims in these Terms.

A11. Advertising, sponsorships, and commercial offers. Sponsored material will be identified as required. Member information will not become available for advertising merely because this clause exists. Tracking, personalized advertising, and sale or sharing of personal information require the disclosures, legal basis, and choices applicable to the actual practice. An advertiser is responsible for its independent offer; Arch remains responsible for its own representations and obligations.

A12. APIs, professional accounts, and services for organizations. Public API access, matchmaking businesses, professional advisers, creator programs, employer access, and institutional use require a separate expressly authorized arrangement. An ordinary personal account does not grant API access, permission to process profiles for clients, or permission to monitor employees or other people.

A13. Research and model improvement. Research participation and new uses of sensitive data must be described separately, with participation choices and consent where required. These Terms do not authorize an experiment that materially changes a user's rights without appropriate notice. Any use of de-identified or aggregate information must satisfy applicable legal standards and must not be used to reidentify participants.

A14. Features requiring a new agreement. Money transfers, lending, insurance, health services, employment screening, commercial background reports, and other regulated offerings are not authorized by this Schedule. If Arch introduces a materially different or regulated service, the necessary licensing, disclosures, provider arrangements, and separate terms must be established first.

Schedule B — Local rights and notices

B1. Mandatory rights. Consumer, dating-service, privacy, payment, online-safety, accessibility, and language laws that apply to your transaction continue to apply even if not expressly listed here. A savings clause does not replace a required disclosure, contractual term, cancellation form, or operational safeguard.

B2. United States. Arch is not currently offered in the United States. Before it is, these Terms will be updated with the notices and forms that applicable state law requires.

B3. Canada. Provincial consumer rights and applicable federal or provincial privacy rights remain available. Any required pre-contract disclosure, retainable copy, cancellation right, refund, and restriction on changing a contract will be honoured. Arch is not currently offered to residents of Quebec.

B4. Expansion to other countries. Before offering the Services in another market, Arch must provide any required local terms and disclosures. Where applicable, those may address withdrawal rights, digital-service guarantees, complaint procedures, local representatives, privacy transfers, age requirements, and platform duties. This draft does not claim to contain a completed worldwide set of local schedules.

Schedule C — App distribution and licences

For an Arch application obtained through Apple's App Store, Apple's Standard Licensed Application End User License Agreement applies to the application licence unless Arch has supplied a valid custom EULA through the applicable process. These Terms govern the Arch service relationship and supplement, rather than purport to replace, that application licence. Mandatory law and applicable Apple usage rules remain controlling. Arch is the service operator and your contact for Arch support.

For another distribution platform, we will identify the applicable licence and purchase rules before installation or purchase. An app-store licence does not make that platform the operator of Arch's dating service. If Arch later adopts a custom Apple EULA, it must meet Apple's minimum requirements; this Schedule is not presented as that custom EULA.
